Part 2 Permitting Regulations

Proposed Rulemaking

On December 10, 2012, the Louisville Metro Air Pollution Control District (District) proposed a set of changes to the District’s Part 2 Permitting program and related regulations for informal comment. These will include proposed amendments to Regulations 1.02, 2.02, 2.03, 2.08, 2.16, 2.17, and 5.00. Informal comments will be taken until 5:00 p.m. January 24, 2013. Please submit your comments to Rachael Hamilton, Board Secretary-Treasurer Louisville Metro Air Pollution Control District, by mail at 850 Barret Ave., Louisville, KY 40204-1745, or electronically via the Internet at the e-mail address airregs @louisvilleky.gov.

The following table identifies the estimated dates for the committee meeting, legal notice publication, Public Hearing, and the date on which the District will recommend that the Board take formal action on the regulation.

Actual dates may differ depending on issues raised during the informal and formal review periods,.

The District hosted a stakeholder meeting on July 25, 2012, to discuss changes to Regulation 2.08 Fees following the release of an advance Notice of Proposed Rulemaking on July 24, 2012. As with the informal comment period, drafts of the proposed regulations will also be sent for formal review to all persons who have requested to be informed of proposed changes to any District regulations; EPA Region 4; and the Kentucky Division for Air Quality. During the formal comment period, pursuant to Regulation 1.08, Administrative Procedures, the public will have a 30-day period in which to make written comments and an opportunity to speak at a public hearing prior to adoption of the regulations. If adopted by the Board, Regulations 1.02, 2.02, 2.03, and 2.17 will be submitted to the U.S. Environmental Protection Agency for inclusion in the State Implementation Plan.
