December 2007 Minutes
Kurt Mason called the meeting to order and asked everyone to look over the December minutes to see if there were any errors. Richard Jett moved that the December minutes be accepted as presented, and Noel Rueff seconded. The motion passed unanimously.
Conservation Activity
Duncan Conservation Easement, 404 Mockingbird Valley Road [22-2004-01]
Theresa Senninger informed everyone about the latest progress on the Duncan site. Mr. Potter will return in February for the Board’s decision about whether a sewer line could be run at the edge of the Duncan estate to serve his adjacent development site. .
Renaissance Zone Wetlands, CE, 2730 Outer Loop [22-2006-02]
Theresa Senninger reported that Louisville/Jefferson County Metro Council Metropolitan Government adopted Resolution 259 Series 2007 sponsored by Councilwoman Vicki Welsh in pursuant with Kentucky Revised Statutes (KRS) 382.800 and Section 170(h) of the Internal Revenue Code on December 20, 2007. The Fee Simple deed was filed on September 20, 2007 in Deed Book 09109 Page 0352. The Deed of Conservation Easement is yet to be filed.
Redwing Ecological Services needs to be contacted on the northern boundary fencing on this property.
Aprile Conservation Easement Frannie Aprile 15404 Taylorsville Road [22-2007-01]
Theresa Senninger reported that Louisville/Jefferson County Metro Council Metropolitan Government adopted Resolution 260 Series 2007 sponsored by Councilman Stuart Benson in pursuant with Kentucky Revised Statutes (KRS) 382.800 and Section 170(h) of the Internal Revenue Code on December 20, 2007. The following day the Deed of Conservation Easement was signed by the Mayor and recorded in Deed Book 09155 Page 0787.
Dogwood Hill Laura Lee Brown 7001 US Highway 42 [22-2007-08] JF-772
Theresa Senninger reported that Louisville/Jefferson County Metro Council Metropolitan Government adopted Resolution 265 Series 2007 sponsored by Councilman Kelly Downard
in pursuant with Kentucky Revised Statutes (KRS) 382.800 and Section 170(h) of the Internal Revenue Code on December 20, 2007. The following day the Deed of Conservation Easement was signed by the Mayor and recorded in Deed Book 09155 Page 0807.
The Board discussed the merit in keeping track of the purchase prices of any sales of properties protected by conservation easements. This can help our understanding of the potential impact of easements on property values and help our review of appraisals.
Lisa advised that a Park Foundation has been set up to raise money and receive and hold private donations and grants for parks-related uses. The Foundation can receive the Brown endowment donation and set up a dedicated endowment fund so it can earn interest.
Kentucky Dept. of Trans. (Mac Sawyer Wetlands)[NE side of I-65 and I-265 inter.][22-2007-02]
Kurt Mason reported on this possible conservation easement in South Central Jefferson County. The land owner, Kentucky Transportation Cabinet, is willing to give the land to Louisville Metro if Metro wants to become the fee simple owner of the property.
Trinity [MSD Conservation Easement] (Rear of) 1800 Outer Loop [22-2000-03]
Dave Fothergill, Major Waltman, and Lee Wells made a site visit to this easement on January 4, 2008. Lee reported that the easement itself seemed to be in pretty good shape, however access to the easement was bothersome at best, and very time consuming. Lee said that since the easement was bounded on the west by the CSX rail yard, and the north and east by UPS the only way in was by a small shipping container company on the south, and that even this entrance may not be available in the future due to expansion of the shipping container facility.
Lee intended to contact CSX and UPS in the near future to see if there was a better way in, and it was conceded that it would be best to clear up this access matter before the CE was transferred to LJCET.
Conservation Easement Monitoring
Noel Rueff suggested that an easement monitoring schedule be developed to take advantage of the excellent visibility and monitoring conditions of winter. Since it had been almost a year since the Van Tilburgs had started building their house on the Donoho CE, it was recommended to monitor that easement first. Next, since it had been monitored in warm weather last it was suggested that Musselman be second. For the third monitoring project, the Culbertson CE was chosen. Mattingly, the ‘Wal-Mart’ easement by New Cut and Outer Loop had an encroachment in the summer of 2007, and Lee wanted to know if there was any information on the encroachment being corrected. Since no one had heard anything, Lee volunteered to call Redwing and see if they had any information. The Duncan CE was then assigned as the final easement before foliage makes GPS readings difficult.
Board and Committee Appointments
The search for Dudley Saunders’s replacement is continuing.
Accreditation Retreat
The Board tentatively agreed to have a retreat to focus on accreditation issues on either April 29, or May 6, 2008. The retreat will be located at a place still to be set.
